Introduction

The use of the DIGIWELL e-learning platform, including web crawling, its caching services and any other services provided by the platform, requires the unconditional acceptance of the terms of use described herein and constitutes their practical acceptance. By accessing or using the platform, you agree to be bound by these terms, as well as the terms of the Privacy and Security Policy. Users are kindly requested to check these terms at regular intervals for any changes, as the continued use of the platform implies that they accept any possible modifications thereto.

Use of the DIGIWELL E-Learning platform

These terms of use apply to the DIGIWELL e-learning platform users. Please read them carefully, because by using this website, you agree to be legally bound by and comply with its terms. If you do not agree with these terms of use, you are not authorized to use the DIGIWELL e-learning platform.

These terms of use apply to the DIGIWELL e-learning platform only, and not to the websites of any other institutions, companies or universities members of the DIGIWELL Consortium.

As mentioned above, these terms of use may be revised from time to time, so please check this web page each time you visit the DIGIWELL e-learning platform. If you continue to use the DIGIWELL e-learning platform after we post the change, this means you have agreed to the new terms.

The DIGIWELL Project’s Consortium (hereinafter referred to as the ‘Partners’) provides access to and use of this e-learning platform on the following terms:

  • You agree to use this website only for legal purposes and in a manner that does not infringe on, limit, or prohibit anyone else’s use and enjoyment of it. Harassing or causing distress or discomfort to others, transmitting obscene or offensive content, or disrupting the regular flow of communication on this website are all prohibited behaviors.
  • You may not probe, scan or test the vulnerability, nor breach the security or authentication measures on the website or any network connected to it.
  • It is strictly prohibited to interfere with the proper functioning of the website, or any other person’s use of the website by using any automatic or manual device, program, algorithm, or methodology.

Please note that the present Terms of Use also include:

  • The ‘DIGIWELL E-Learning Platform Privacy and Security Policy’ that also applies to the use of the e-learning platform.

Intellectual Property

The DIGIWELL Consortium holds all copyright, trademarks, design rights, patents, and other intellectual property rights (registered and unregistered), as well as all content on this e-learning platform. Users must respect all copyright notices and restrictions contained on the DIGIWELL e-learning platform.

Unless otherwise specifically stated, it is strictly prohibited to copy, reproduce, republish, disassemble, decompile, download, post, broadcast, transmit, or make available to the public any DIGIWELL training material (portion, file, content or information).

You may only download one machine-readable copy of the purposely provided website materials under the following terms:

  • Only for personal, non-commercial use
  • Only if you do not make any changes to the text or remove any trademark, copyright, or any other notice displayed on the website materials.

Accuracy of Content and Information

The DIGIWELL training material content has been carefully checked at best of knowledge. However, all warranties, terms and conditions of satisfactory quality and fitness for purpose are excluded to the fullest permitted by Law.

In particular, DIGIWELL partners shall not be liable for any direct, indirect, consequential, or other damages suffered by a trainee or any third party resulting from the use of the content of the DIGIWELL e-learning platform and/or training programs.

The DIGIWELL training material may be updated as required by DIGIWELL partners at any time within the DIGIWELL training program to reflect knowledge update, educational improvement or correct any errors that may have been detected.

These terms of use apply only to the DIGIWELL e-learning platform, and not to other websites. When we link to other websites we will try to make it as clear as possible that you are leaving this website. In case the users of the DIGIWELL platform are redirected to third party websites through special links (links, hyperlinks, banners, etc.) we are not responsible for the terms of management and protection of personal data that these websites follow and we recommend that you read the privacy policy of each site you are visiting.

Service compliance and security

Although we make every effort to design, program, and provide the best website possible, we cannot guarantee that this website, or any content, service, or feature of this website, will be error-free, uninterrupted, or compliant with all hard- and software, or that your use of the website will lead to the desired results. This website and its contents are provided “as-is” and “as-available”.

Minimal IT skills and equipment are required for the DIGIWELL e-learning platform:

  • Broadband Internet access
  • A modern web browser that complies with nowadays web standards and activates features such as session cookies (platform authentication), JavaScript (platform tool features, interactivity, visual effects, etc.), Adobe Reader® plugin (pdf document view), etc.
  • An office software suite properly installed and configured on your computer to process standard text, spreadsheet or presentation files.

IMPORTANT: Non-complying with any of the above criteria could lead to user experience problem that would not be under DIGIWELL responsibility.

Finally, although we work very hard to develop the most secured website possible, we cannot guarantee that any files or data you download from the site will be free of viruses or destructive features. You are responsible for taking appropriate steps to ensure that you regularly check for viruses when using this website on any device.

Web accounts

You are entirely responsible for keeping your account information confidential (including username and password).

In particular, you should:

By using the DIGIWELL e-learning platform:

  • You agree not to use anyone else’s DIGIWELL e-learning platform account without the express permission and consent of the holder of that account
  • You acknowledge that the DIGIWELL Consortium cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

General Liability Terms

We exclude, to the fullest extent permissible by Law, all liability for any loss or damages (direct, indirect, or consequential) relating to these terms, or to your (or any third party’s) use or inability to use the e-learning platform, or to your placement of content on the e-learning platform, or to your reliance upon information obtained from or through the e-learning platform.

You agree to defend, indemnify and hold us, our directors, employees and agents harmless from and against any and all claims, liabilities, damages, losses or expenses, including reasonable legal costs, arising out of or in any way connected with any breach of these terms of use by you.
